Arbitrary Justice
By: Davis, Angela J.
Published by: Oxford University Press, USA

Inscribed on the walls of the United States Department of Justice are the lofty words: "The United States wins its point whenever justice is done its citizens in the courts." Yet what happens when prosecutors, the most powerful officials in the criminal justice system, seek convictions instead of justice? Why are cases involving educated, well-to-do victims often prosecuted more vigorously than those involving poor, uneducated victims? Why do wealthy defendants frequently enjoy more lenient plea bargains than the disadvantaged?. In this timely work, Angela J. Davis examines the expanding power of prosecutors, from mandatory minimum sentencing laws that enhance prosecutorial control over the outcome of cases to the increasing politicization of the office. Drawing on her dozen years of experience as a public defender, Davis demonstrates how the everyday, legal exercise of prosecutorial discretion is responsible for tremendous inequities in criminal justice. Davis uses powerful stories of individuals caught in the system to illustrate how the day-to-day practices and decisions of well-meaning prosecutors produce unfair and unequal treatment of both defendants and victims, often along race and class lines. These disparities are particularly evident in prosecutors' charging and plea-bargaining decisions and in their muddy relationships with victims. Prosecutors not only hold vast power, Davis argues, but they are also under-regulated and lack accountability. The current standards of practice for prosecutors are unenforceable, while the mechanisms that purport to hold prosecutors accountable are weak and ineffectual. Not only does lack of oversight result in injustices, it may even foster a climate tolerant of unfair practices and in some cases, misconduct. Offering a sensible agenda for comprehensive review and reform, Arbitrary Justice challenges the legal community and concerned citizens to pursue and enact meaningful standards of conduct and effective me more...

Auslieferung Und Europaischer Haftbefehl
By: Murschetz, Verena, LL.M.
Published by: Springer

Umsetzungsgesetzes gegen??bergestellt. more...

Bloy & Parry's Principles of Criminal Law
By: Bloy, Duncan; Molan, Mike; Lanser, Denis
Published by: Routledge-Cavendish

This book is primarily intended for use by undergraduate law students, and those on CPE/postgraduate diploma courses, who need to study criminal law as part of the academic stage of training for qualification into the legal profession. Students studying on mixed law degrees, for the Open University, or on non-law modular courses where criminal law is offered as an element of the course programme, will also find the book an invaluable study aid. The content is accessible, concise and up to date, providing an overview of the key aspects of criminal law doctrine as it applies in England and Wales. In addition to providing an explanation of the substantive law, the text draws on a variety of sources, such as case law, statute law, Law Commission publications and academic commentary, to illustrate the operation of criminal law in practice and to consider proposals for reform. The format of the book acknowledges the pressures on the study time available to many students - there are quick reference summaries and useful suggestions as to further reading for each chapter. Readers are encouraged to adopt an analytical approach to their study of the subject consistent with their legal knowledge. The authors have taken into account the fact that, for the majority of students, this will be their first opportunity to study criminal law. This fourth edition includes analysis of recent important case law, including decisions of the House of Lords in B v DPP (strict liability), R v Powell and Daniel; R v English (accessorial liability), R v Smith (provocation) and R v Woolin (mens rea for murder). The likely impact of the incorporation of the European Convention on Human Rights by means of the Human Rights Act 1998 is also considered, particularly the effect this will have on the interpretation of statutory offences and the enforcement of common law offences. more...
