Climate Change Policy
By: Helm, Dieter (ed.)
Published by: OUP Oxford

The threat posed by climate change has not yet been matched by international agreements and economic policies that can deliver sharp reductions in greenhouse-gas emissions. Although the Kyoto Protocol has now been ratified by Russia and hence come into legal effect, the USA, China, and India are all outside its emissions caps. Few European countries are on course to meet their own national targets, and even if fully implemented, it is widely acknowledged that the Kyoto Protocol. would make little difference to the carbon concentrations in the atmosphere. In consequence, there is a search for a post-Kyoto framework, new institutions, and new economic policies to spread the costs and meet them in an economically efficient way. This volume provides an accessible overview of the. economics of climate change, the policy options, and the scope for making significant carbon reductions. - ;The threat posed by climate change has not yet been matched by international agreements and economic policies that can deliver sharp reductions in greenhouse-gas emissions. Competion Law, Environmental Policy and Producer Responsibility
By: Vedder, H.H. B.
Published by: Europa Law Publishing

The proposed Directive on waste electrical and electronical equipment envisages a producer responsibility. This means that producers and importers will be made responsible for the collection and recycling of these products once they have reached the end of their life. Similar legislation in the Netherlands has resulted in a collective producer responsibility organisation funded by a disposal fee. The establishment of such collective organisations is encouraged by environmental legislation. However, competition law is critical of such co-operation particularly with regard to the disposal fee that is to be passed on to consumers. This study examines the environmental and competition law applicable to producer responsibility organisations. In this regard, the experiences in the Netherlands and a number of other European countries have been studied. It comes to the conclusion that competition law and environmental law may not pull in the same direction. The study suggests a number of possible solutions for the conflict between environmental and competition law in this field. more...

Constitutionalism, Multilevel Trade Governance and Social Regulation
By: Joerges, Christian (ed.); Petersmann, Ernst-Ulrich (ed.)
Published by: Hart Publishing, Ltd

This is a book about the ever more complex legal networks of transnational economic governance structures and their legitimacy problems. It takes up the challenge of the editors' earlier pioneering works which have called for more cross-sectoral and interdisciplinary analyses by scholars of international law, European and international economic law, private international law, international relations theory and social philosophy to examine the interdependences of multilevel governance in transnational economic, social, environmental and legal relations. Two complementary strands of theorising are expounded. One argues that globalisation and the universal recognition of human rights are transforming the intergovernmental 'society of states' into a cosmopolitan community of citizens which requires more effective constitutional safeguards for protecting human rights and consumer welfare in the national and international governance and legal regulation of international trade. The second emphasises the dependence of the functioning of international markets and liberal trade on governance arrangements which respond credibly to safety and environmental concerns of consumers, traders, political and non-governmental actors. Enquiries into the generation of international standards and empirical analyses of legalization and judizialisation practices form part of this agenda. The perspectives and conclusions of the more than 20 contributors from Europe and North-America cannot be uniform. But they converge in their search for a constitutional architecture which limits, empowers and legitimises multilevel trade governance, as well as in their common premise that respect for human rights, private and democratic self-government and social justice require more transparent, participatory and deliberative forms of transnational 'cosmopolitan democracy'. more...
