The Constitution As Political Structure
By: Redish, Martin H.
Published by: Oxford University Press (US)

Over the last forty years modern constitutional scholarship has concentrated on an analysis of rights, while principles of constitutional law concerning the structure of government have been largely downplayed. The irony of this interpretive emphasis is that the body of the Constitution contains relatively little dealing directly with rights. Rather, it is primarily a blueprint for the establishment of a complex form of federal-democratic structure. This work emphasizes the central role served by the structural portions of the Constitution. Redish argues that these structural values were designed to provide the framework in which our rights-based system may flourish, and that judicial abandonment of these structural values threatens the very foundations of American political theory.  more...

The Constitution in Congress
By: Currie, David P.
Published by: The University of Chicago Press

This acclaimed series serves as a biography of the U.S. Constitution, offering an indispensable survey of the congressional history behind its development. In a rare examination of the role that both the legislative and executive branches have played in the development of constitutional interpretation, The Constitution in Congress shows how the actions and proceedings of these branches reveal perhaps even more about constitutional disputes than Supreme Court decisions of the time. The centerpiece for the fourth volume in this series is the great debate over slavery and how this divisive issue led the country into the maelstrom of the Civil War. From the Jacksonian revolution of 1829 to the secession of Southern states from the Union, legal scholar David P. Currie provides an unrivaled analysis of the significant constitutional events—the Wilmot Proviso, the Compromise of 1850, the Kansas-Nebraska Act, the Lincoln-Douglas Debates, and "Bleeding Kansas"—that led up to the war. Exploring how slavery was addressed in presidential speeches and debated in Congress, Currie shows how the Southern Democrats dangerously diminished federal authority and expanded states' rights, threatening the nation's very survival. Like its predecessors, this fourth volume of The Constitution in Congress will be an invaluable reference for legal scholars and constitutional historians alike. more...

Constitutional Documents of Chile 1811–1833
By: Dippel, Horst
Published by: K.G.Saur

The book edition of Constitutions of the World from the late 18th Century to the middle of the 19th Century is the most complete and academically thorough collection of its kind. It contains constitutional documents from all over the world, written from 1776 to the end of the year 1849. This collection includes about 1,000 constitutions, human rights declarations, and draughts of constitutions that never came into force, from this period. These early constitutional documents were collected and examined in archives and libraries all over the world, as part of a project by the Deutsche Forschungsgemeinschaft (German Research Foundation). Using the original documents, experts from American and European universities reconstructed the authentic constitution texts for each country, and annotated them in their respective original languages. Each volume contains a short introduction, a main part with the edited constitution documents of a country, comments and an index. The unique value of the complete edition lies in its making all constitutions, from the early phase of modern constitutionalism, accessible in a reliable, authentic text version for the first time. These constitutions were widely scattered until now and, in many cases, unknown. In all, constitutional documents from about 50 countries in Europe and the Americas will be published in volumes for each country. Constitutions of the World from the late 18th Century to the Middle of the 19th Century is a unique and fundamental source edition and an extensive documentation of constitutional history. At the same time, it supplements the microfiche edition Constitutions of the World 1850 to the Present, also published by K. G. Saur Verlag. more...
