Regulating Older Drivers
By: Loughran, David S.; Seabury, Seth A.; Zakaras, Laura
Published by: RAND Corporation

Are older drivers posing an increasing risk to the public? If they are, what options should policymakers consider to mitigate that risk? This research offers a new perspective on these questions. Using an innovative approach to estimate the extent to which older drivers are on the road and their riskiness compared with drivers of other age groups, the study finds that older drivers (those 65 and older) are slightly (16 percent) likelier than drivers aged 25 to 64 to cause an accident and that they pose much less risk to the public than do drivers aged 15 to 24, who are nearly three times likelier than older drivers to cause an accident. However, because of their greater frailty, older drivers are much likelier than other drivers to be seriously injured or killed when involved in an accident. In light of these findings, the authors find little support for the idea that stricter licensing policies targeting older drivers would substantially improve traffic safety. more...

Religion and Personal Law in Secular India
By: Larson, Gerald J. (ed.)
Published by: Indiana University Press

Though a directive principle of the constitution, a uniform civil code of law has never been written or instituted in India. As a result, in matters of personal law the segment of law concerning marriage, dowry, divorce, parentage, legitimacy, wills, and inheritance individuals of different backgrounds must appeal to their respective religious laws for guidance or rulings. But balancing the claims of religious communities with those of a modern secular state has caused some intractable problems for India as a nation. Religion and Personal Law in Secular India provides a comprehensive look into the issues and challenges that India faces as it tries to put a uniform civil code into practice. more...

Secrets, Sex, and Spectacle
By: West, Mark D.
Published by: The University of Chicago Press

A leader of a global superpower is betrayed by his mistress, who makes public the sordid details of their secret affair. His wife stands by as he denies the charges. Debates over definitions of moral leadership ensue. Sound familiar? If you guessed Clinton and Lewinsky, try again. This incident involved former Japanese prime minister Sosuke Uno and a geisha. In Secrets, Sex, and Spectacle, Mark D. West organizes the seemingly random worlds of Japanese and American scandal—from corporate fraud to baseball cheaters, political corruption to celebrity sexcapades—to explore well-ingrained similarities and contrasts in law and society. In Japan and the United States, legal and organizational rules tell us what kind of behavior is considered scandalous. When Japanese and American scandal stories differ, those rules—rules that define what’s public and what’s private, rules that protect injuries to dignity and honor, and rules about sex, to name a few—often help explain the differences. In the cases of Clinton and Uno, the rules help explain why the media didn’t cover Uno’s affair, why Uno’s wife apologized on her husband’s behalf, and why Uno—and not Clinton—resigned. Secrets, Sex, and Spectacle offers a novel approach to viewing the phenomenon of scandal—one that will be applauded by anyone who has obsessed over (or ridiculed) these public episodes. more...

Shifts in Compensating Work-related Injuries and Diseases
By: Klosse, Saskia (ed.); Hartlief, Ton (ed.)
Published by: Springer

Inspired by developments mirroring shifts in the legal basis for compensating damage from civil law to public funding and vice versa, this book examines the developments in compensation systems for damage arising from work-related injuries and diseases. The shifts which have occurred in this area in Germany, England, Belgium and the Netherlands are the subject of this volume. The shifts in the legal doctrine, legislation and the case law of these countries will first be mapped from a historical and comparative perspective, with the aim of discovering the precise nature of the given shifts. Subsequently the shifts will be analysed and explained on the basis of the legal history so as to comprehend the reasons behind the shifts. Finally, the effects of the shifts will be examined. Did the shifts have the desired effects or did other, perhaps unexpected, effects arise and if so why and in what form? An economic analysis of law will be included to provide an answer to these questions. more...
