Why have some legal systems abandoned tort law in some areas and replaced it with some form of no-fault compensation scheme or strict liability? What have been the effects? How should we evaluate these ???shifts???? Why have they not been adopted in other countries? These questions have been the focus of the "Shifts in Compensation" research project and this is the final volume in this series, addressing, on the one hand, the issues relating to ???shifts??? in compensation systems at a more general level, and on the other hand, addressing shifts in particular domains. The papers examining the shifts at a more general level provide a framework for the analysis of the various shifts and explain the shifts towards an increasing use of strict liability and no-fault regimes. To what extent shifts in compensation can be explained by insurance markets and their relative flexibility is also dealt with. In addition, shifts in the specific areas of medical mishaps and disasters are also examined. This book brings together lawyers and economists from various jurisdictions thus providing a multidisciplinary approach to tort law and alternative instruments.

Shifts in Compensation for Environmental Damage

This volume examines the shifts in the compensation of environmental damage between private and public systems. Recent developments at both the European and international level are presented with a particular focus on the shifts relating to the compensation of oil pollution, damage arising as a result of nuclear accidents and soil pollution in particular legal systems (Belgium, the Netherlands, Germany and the U.S.A.). Attention is also paid to shifts between various levels of government as far as compensation for environmental damage is concerned. The authors discuss the nature of the particular shift and examine whether the shift is always from private law to public funding. The reasons for the introduction of the shifts and their effects are also examined as well as the consequences of the various shifts in the oil pollution regime from an economic perspective. Finally attention is also paid to various evolutions within private legal funding mechanisms to compensate for environmental damage. New developments, such as the shift towards voluntary compensation schemes and environmental damage insurance, are also presented and critically discussed.

Drei inhaltliche Bereiche werden im Detail untersucht: 1. Privatautonom abgeschlossene VertrAge werden in verschiedenen ZusammenhAngen einer inhaltlichen Kontrolle unterzogen. Bei dieser kommt es hAufig auf das VerhAltnis der Werte von Leistung und Gegenleistung an. Wenn ein Wert den anderen deutlich A1/4bersteigt, kann der Vertrag fA1/4r den Benachteiligten unverbindlich sein. Um zu beantworten, welche Werte zu vergleichen sind, muss der Zweck der entsprechenden Bestimmungen untersucht werden. 2. VermAgensA1/4bertragungen erfolgen nicht nur aufgrund von VertrAgen. HAufig rAumt die Rechtsordnung einer Partei die MAglichkeit ein, eine solche Aoebertragung einseitig herbeizufA1/4hren. Paradigma ist die Enteignung, bei der die EigentumsA1/4bertragung durch behArdlichen Akt erfolgt. FA1/4r die Bemessung der EigentumsentschAdigung stellt sich die Frage nach dem Wert des Enteignungsobjekts, A1/4blicherweise einer Liegenschaft. GegenA1/4ber der Vertragskontrolle stehen unterschiedliche Aspekte im Vordergrund; ausschlaggebend sind effizienzorientierte Aoeberlegungen. 3.
